La agrobiotecnología ha ampliado el hecho técnico agrario, basamento fáctico del derecho agrario, mientras que el principio de precaución, como elemento esencial de la bioseguridad, viene a ponerle un límite jurídico. Esto provoca que estemos en presencia de un nuevo Derecho Agrario que responde al desafío de la interacción con la tecnología contemporánea.
