It establishes that protest is a fundamental right derived from the freedoms of assembly and expression, and that, by its nature, it is not absolute. The study highlights that road blockades disproportionately affect the rights of others, impacting free movement, health, and the national economy. It concludes that there is no autonomous right to blockades within the legal system, identifying its political instrumentalization as a de facto action. Finally, a set of regulatory criteria is proposed to guarantee a balance between the exercise of dissent and the rule of law. El presente artículo analiza los límites del derecho a la protesta, particularmente el bloqueo de vías, en el marco del derecho internacional y el ordenamiento jurídico boliviano. Se establece que la protesta es un derecho fundamental derivado de las libertades de reunión y expresión, y que, por su naturaleza, no posee un carácter absoluto. El estudio destaca que los bloqueos de vías generan afectaciones desproporcionadas sobre los derechos de terceros, impactando la libre circulación, la salud y la economía nacional. Se concluye que no existe un derecho autónomo al bloqueo en el sistema normativo, identificando su instrumentalización política como una vía de hecho. Finalmente, se proponen un conjunto de criterios regulatorios orientados a garantizar el equilibrio entre el ejercicio del disenso y la vigencia del Estado Constitucional de Derecho.
