The qualitative approach developed through the review of doctrines and theories corroborates that the Resolutions of international organizations can be considered specific sources of law, depending on the manner of approval and the content. The Charter, having been adopted unanimously by the General Assembly of the Organization of American States on September 11, 2001, and promoting democracy as a right, value, and principle, is a binding instrument that provides preventive and sanctioning mechanisms against States that disrupt the democratic order. The study of cases supports its effectiveness and practical application, which in certain situations has been limited by political interests and requires a review of its implementation. Este artículo tiene como objetivo demostrar que la Carta Democrática Interamericana es una fuente del Derecho Internacional Americano. El enfoque cualitativo desarrollado mediante la revisión de doctrinas y teorías, corrobora que las Resoluciones de organizaciones Internacionales pueden ser consideradas fuentes particulares del Derecho, según la forma de aprobación y el contenido. La Carta, al haber sido adoptada por la Asamblea General de la Organización de Estados Americanos de forma unánime, el 11 de septiembre de 2001, y desarrollar la Democracia como derecho, valor y principio, es un instrumento de cumplimiento obligatorio que prevé mecanismos preventivos y sancionatorios en contra de los Estados que alteran el orden democrático. El estudio de casos respalda su efectividad y aplicación práctica, que en determinadas situaciones, se ha visto limitada por intereses políticos y que exige una revisión de su aplicación.
