It analyzes the legal framework established by Law No. 11,029, along with subsequent changes such as those introduced by the Urgent Consideration Law No. 19,889 of 2020. Through a document-based review and an analysis of academic literature, the study explores the implications of INC's legal regime on land access, agrarian distribution, tenure models, and its role as a regulator of land value. Advantages, limitations, and tensions surrounding the social function of land, the state's preferential acquisition right, and new associative colonization models are discussed. The article concludes by emphasizing the strategic importance of the INC as a guarantor of a public-oriented agrarian policy, essential for the sustainability and equity of the Uruguayan rural environment.   Resumen Este artículo examina la evolución normativa e institucional del Instituto Nacional de Colonización (INC) de Uruguay, desde su creación en 1948 hasta la actualidad. Se analiza el marco legal fundacional establecido por la Ley N.° 11.029, así como las modificaciones posteriores que han redefinido el accionar del instituto, incluyendo las introducidas por la Ley de Urgente Consideración N.° 19.889 de 2020. A través de una revisión documental y un análisis de la literatura académica, se estudian las implicancias del régimen legal del INC sobre el acceso a la tierra, la distribución agraria, el modelo de tenencia, y su papel como regulador del valor de la tierra. Se discuten ventajas, limitaciones y tensiones en torno a la función social de la tierra, el derecho de preferencia estatal, y los nuevos modelos asociativos. El artículo concluye destacando el valor estratégico del INC como garante de una política agraria con orientación pública y social, fundamental para la sostenibilidad y equidad del medio rural uruguayo.
