While IHL primarily applies during international or non-international armed conflicts to limit their effects, IHRL obliges states at all times. This results in the convergence and interaction of both legal frameworks during the duration of a conflict. Although the Inter-American Court of Human Rights (IACHR) does not have material jurisdiction to declare violations of the Geneva Conventions or their Optional Protocols, which embody the main norms of IHL, the Court has referred to them in various rulings. This paper aims to analyze why, how, and on what legal grounds the IACHR has used IHL provisions to determine the scope of the obligations of states party to the American Convention on Human Rights with respect to their inhabitants in such contexts. To this end, the paper examines the Court’s rulings and relevant scholarly doctrine on the subject El Derecho Internacional de los Derechos Humanos (DIDH) y el Derecho Internacional Humanitario (DIH) son ramas complementarias del Derecho Internacional Público que tienen por finalidad la protección de los individuos. Mientras que el DIH actúa esencialmente en tiempos de conflictos armados internacionales o no internacionales, con el objetivo de limitar sus efectos, el DIDH obliga a los Estados en todo momento. Esto resulta en la convergencia e interacción de ambos ordenamientos durante la vigencia de un conflicto. Si bien la Corte Interamericana de Derechos Humanos (Corte IDH) no tiene competencia material para declarar violados los Convenios de Ginebra ni sus protocolos facultativos, instrumentos que concentran las principales normas del DIH, el Tribunal ha recurrido a ellos en diferentes fallos. El objetivo de este trabajo es analizar por qué, cómo y con qué fundamentos jurídicos la Corte IDH ha utilizado las disposiciones del DIH para determinar el alcance de las obligaciones de los Estados firmantes de la Convención Americana de Derechos Humanos en relación con sus habitantes en este tipo de contextos. Para ello, se realiza un análisis de las sentencias de la Corte IDH y de la doctrina relevante en la materia.
