La creación de un sistema de protección de los derechos del consumidor en tanto parte supuestamente más débil de la relacióncontractual surge a partir del reclamo que los propios consumidores realizan a medida que logran ser visibilizados y se ha ido desarrollando paulatinamente hasta nuestros días en los que aún se vislumbran apenas algunos fallos judiciales cuyo marcoaxiológico o valorativo se fundamenta en el principio del favor debilis en relación al Derecho de Consumo.
