Fields such as medicine, feminism, religion, and politics produced a series of debates that provided or denied an opening to the legalization of abortion. It has not been a linear process, rather it has been a path of progress and setbacks where the implementation of the sentence was affected by the same time that there was a permanent struggle for the demand of women’s rights and in the requirement of compliance with the law. Religious stances and their involvement in politics were challenged by scientific and legal scrutiny, as well as by the efforts of the feminist movement, breaking through the hegemony of clerical positions against abortion and paving the way for the discourse of women’s rights and public health, as enshrined in the law. En este texto abordaremos las discusiones jurídicas y políticas que se dieron entre sectores de la sociedad colombiana que abrieron un espacio de posibilidades para la transformación legal a través del surgimiento de la sentencia C-355 de 2006 que despenalizó parcialmente el aborto. Campos como el de la medicina, el feminismo, la religión y la política produjeron una serie de debates que habilitaban o negaban una apertura ante la legalización del aborto. No se trató de un proceso lineal, se trató de un camino de avances y retrocesos en una lucha permanente por la reivindicación de los derechos de las mujeres, la despenalización del aborto y la exigencia por el cumplimiento de la ley. Las posturas religiosas y su intervención en la política fueron desafiadas por los cuestionamientos científicos y jurídicos y por las luchas del movimiento feminista, perforando la hegemonía de las posturas clericales en contra del aborto y dando paso al discurso de los derechos de las mujeres y la salud pública materializados en la ley.
