Análisis de la Ley n° 26.854 Herrera Aquilino, Esteban Fernando medidas cautelares ley 26.854 Estado nacional proceso contencioso administrativo precautionary measures law 26.854 national State contentious process This work address the different issues debated with the sanction of the law of precautionary measures N° 26.854 in which the National State is a party or intervenes, investigating the relationship between the precautionary protection and the fundamental guarantee of an effective judicial protection, delving into the different innovative contributions given by the legislation under analysis, such as the report prior to the dispatch of the precautionary measure; the reasonable term of validity; the procedural regime differentiated according to the nature of the material right that the precautionary claim brings into play; the different kinds of measures legislated; and the preponderant role assumed by the public interest according to the type of measure requested, as well as the incorporation of a constitutional social state of law to the Argentine contentious process and its impact on justice. An attempt will be made to unravel the importance that the “precautionary measures against the national State” came to occupy, the incorporation of precautionary protection in the Argentine contentious administrative process, relevant amendments such as the previous report, the public interest involved and the subjects of special consideration, as well as the practical application in the Argentine legal system since the sanction of Law N° 26.854. Este trabajo aborda los diferentes temas debatidos con la sanción de la Ley de Medidas Cautelares en las causas que es parte o interviene el Estado Nacional N° 26.854, indagando la relación existente entre la protección cautelar y la garantía fundamental de una tutela judicial efectiva. Asimismo, el artículo profundiza los aportes novedosos de la legislación bajo análisis, tales como el informe previo al despacho de la cautelar, la medida interina, el plazo razonable de vigencia temporal, el régimen procesal diferenciado según la naturaleza del derecho material que la pretensión cautelar ponga en juego y las diferentes clases de medidas legisladas. De la misma forma, el papel preponderante que asume el interés público según el tipo de medida solicitada, como también la incorporación de un estado social constitucional de derecho al proceso contencioso argentino y su repercusión en la justicia. El trabajo intenta desentrañar la importancia o el rol definitivo que ocupan las “medidas cautelares contra el Estado nacional”, la incorporación de la tutela cautelar al proceso contencioso administrativo argentino, las modificaciones relevantes introducidas como el informe previo, el plazo razonable, el interés público comprometido y los sujetos de especial consideración y por último, la aplicación práctica en el ordenamiento jurídico argentino a partir de la sanción de la Ley N° 26.854.
