It is the purpose of this paper to challenge such dichotomy —particularly in the context of its relevance within the gender theory— through the analysis of the role played by testimonies given during the Argentine trials on sexual violence, as crimes against humanity perpetrated during the last dictatorship. Specifically, it questions the usual approach which sees in these testimonies a path to re-victimization, since understand-ing that such perspective is based on a number of dichotomies that are highly arguable. We propose is to analyze this issue considering the role of the affects involved, and one in particular which is frequently stigmatized: shame. For such purposes we have used the concept of affects as presented by authors such as Sedgwick, Ahmed and Ngai, that is, under the certainty that affects refer both to body and mind, involving both passions and actions. The particular subject of analysis are so called “meta-tes-timonies” in reference to what victims say or in any way express with respect to the same act of rendering testimony. El concepto de victimización ha sido tradicionalmente analizado en oposición radical al de agencia: la pasividad de la herida frente a la potencia de la capacidad de acción. El objetivo de este trabajo consiste en desafiar esta dicotomía —particularmente bajo el modo en que se despliega en el marco de la teoría de género— a través de un análisis del papel de los testimonios prestados en los juicios argen-tinos sobre violencia sexual en tanto crímenes de lesa humanidad producidos durante la última dictadura. Primordialmente cuestiona la frecuente lectura que ve en estos testimonios un camino hacia la revictimización entendiendo que esa apreciación está sostenida en una serie de dicotomías sumamente problemáticas. Propone analizar la cuestión atendiendo al papel de los afectos involucrados, en particular a uno frecuentemente estigmatizado, como es la vergüenza. Esta tarea es encarada bajo una concepción de los afectos al estilo de la presentada por autoras como Sedgwick, Ahmed y Ngai, es decir, bajo la certeza de que los afectos se refieren tanto al cuerpo como a la mente involucrando tanto a las pasiones como a las acciones.
