Antes de comenzar con el desarrollo de la tesis, y a modo de introducción, se realizará un resumen de los antecedentes de la causa para luego plantear los principales temas a desarrollar, con el objeto de llegar a la conclusión de si se ratifica o no la sentencia dictada por el Tribunal donde se radicó la misma.
