El presente trabajo tiene como objetivo analizar el principio del interés superior del niño en las actuales intervenciones en el área de niñez, partiendo del siguiente interrogante: ¿el interés superior del niño es un principio orientador en el abordaje tendiente a la efectivización de derechos? De este modo, se parte de analizar el principio del Interés Superior del Niño explicitando su desarrollo histórico, las características que ha presentado durante el Patronato de Menores y las características que asume en la actualidad en el Sistema de Promoción y Protección Integral de Derechos del niño. En relación con esto último se profundizará sobre el carácter que asume la nueva institucionalidad que la adecuación legislativa ha implicado para la efectivización de derechos de todos los niños. Por último, a fin de indagar respecto a las concepciones e interpretaciones del Interés Superior del Niño se analizarán las medidas de protección especial de derechos adoptadas por un Servicio Local desde enero de 2015 hasta junio del mismo año. Con el análisis planteado se busca identificar en la dinámica de funcionamiento del SPPID cómo se utiliza la categoría del Interés Superior del Niño por parte de los profesionales en el marco del actual tratamiento realizado por el Estado a través de las políticas sociales implementadas hacia los NNA y sus familias, a fin de contribuir con un debate tendiente a la construcción de una intervención profesional hacia la niñez crítica y garante de derechos. This paper analyze the principle of the Child´s best interest in the current interventions in the area of childhood, starting from the following question: Is the child´s best interest a guiding principle in the approach towards the realization of rights? In this way, it starts from analyzing the principle of the Superior Interest of the Child, explaining its historical development, the characteristics that it has presented during the Children's Patronage and the characteristics that it currently assumes in the System of Promotion and Integral Protection of Rights of the Child. In relation to this last one will deepen on the character assumed by the new institutionality that the legislative adaptation has implied for the realization of the rights of all the children. Finally, in order to investigate the conceptions and interpretations of the Higher Interest of the Child, the special rights protection measures adopted by a Local Service from January 2015 to June of the same year will be analyzed. The analysis proposed seeks to identify in the dynamics of operation of the SPPID how the category of the Superior Interest of the Child is used by professionals within the framework of the current treatment carried out by the State through the social policies implemented towards children and adolescents.
