Este procedimiento se da en un contexto de alto interés por la comunidad internacional en buscar respuestas a la crisis climática, que ha llevado a la creciente judicialización de la problemática ante distintos órganos judiciales. Puntualmente, esta opinión consultiva buscó dar respuesta a cuáles son las obligaciones de los Estados parte a la Convención de las Naciones Unidas sobre el Derecho del Mar para prevenir, reducir y controlar la contaminación del medio marino, así como también para protegerlo y preservarlo, en relación con los efectos perjudiciales del cambio climático. En su respuesta, el Tribunal estableció importantes criterios e interpretaciones del derecho internacional a fin de dar respuesta a las preguntas solicitadas. Aquí se rescatan los principales antecedentes de la solicitud, para luego tratar las cuestiones de jurisdicción. Se describen las respuestas a las preguntas solicitadas, en especial las relativas a la aplicación de las normas ambientales a los impactos negativos del cambio climático en los océanos. Se finaliza resaltando los aportes de la opinión y las posibles perspectivas para el derecho internacional. This paper describes the advisory opinion on climate change and oceans issued by the International Tribunal for the Law of the Sea. The procedure takes place in a context of high interest by the international community in seeking answers to the climate crisis. Different tribunals have been seized with cases entailing climate issues. Specifically, this advisory opinion sought to respond to the obligations of States parties to the United Nations Convention on the Law of the Sea to prevent, reduce and control pollution of the marine environment, as well as to protect and preserve it, in relation to the deleterious effects of climate change. In the opinion, the Tribunal established important criteria and interpretations of international law in order to answer the requested questions. The paper begins with the background of the request, then jurisdictional issues are presented. It then describes the answers to the questions requested, especially those relative to the application of environmental rules to the negative impacts of climate change in the oceans.
