Using a legal-dogmatic methodology, it examines the tensions between formal equality and real inequality faced by migrants and economically disadvantaged persons in accessing international justice. It highlights that migration, in itself, constitutes a source of vulnerability, whereas poverty must be demonstrated in each specific case as an obstacle to the effective exercise of rights. The study identifies a sufficient normative basis—both domestic and international—that obliges States to guarantee equality before the law and access to justice without discrimination. Through the analysis of jurisprudence, it is shown that due process requires differentiated protective measures, free legal assistance, and the removal of economic and linguistic barriers. The paper proposes a Private International Law of the vulnerable, guided by human dignity and the effectiveness of rights, combining international instruments, judicial technology, and redistributive public policies. Vulnerability generates need, and in the face of necessity, a law that provides effective responses must emerge. El trabajo analiza cómo las migraciones y la pobreza operan como factores de vulnerabilidad en el Derecho Internacional Privado contemporáneo. A partir de una metodología jurídico-dogmática, se examinan las tensiones entre la igualdad formal y la desigualdad real que enfrentan las personas migrantes y económicamente débiles en el acceso a la justicia internacional. Se destaca que la migración, por sí, constituye causa de vulnerabilidad, mientras que la pobreza debe acreditarse en el caso concreto como obstáculo para el ejercicio efectivo de derechos. El estudio identifica una base normativa suficiente, tanto interna como internacional, que impone a los Estados garantizar la igualdad ante la ley y el acceso a la justicia sin discriminación. A través del análisis de la jurisprudencia, se demuestra que el debido proceso exige medidas diferenciadas de protección, asistencia jurídica gratuita y eliminación de barreras económicas y lingüísticas. Se propone un Derecho Internacional Privado del vulnerable, orientado por la dignidad humana y la efectividad de los derechos, que combine instrumentos internacionales, tecnología judicial y políticas públicas redistributivas. La vulnerabilidad genera necesidad, y frente al estado de necesidad debe surgir un derecho que otorgue respuestas.
