Sumario:This paper analyzes a recent ruling of the Supreme Court of Justice of the Nation, in which the court examines the precautions to enforce the responsibility of the State. The sentence, beyond condemning the province to repair the damage caused by the lack of prevention tasks, sets useful parameters to determine the existence of lack of service in cases of omission: the nature of the due state activity, the means available to the service, the link between the victim and the service and the degree of foreseeability of the damage.
