We focus on two aspects of this relationship: the legal limits of the State and its moral justification through an appeal to a supra-legal concept of law. The exposition is divided into three parts, each dedicated to one of these theorists. In the first part, we address Jellinek's theory of the two faces of the State, according to which the State is, on the one hand, a social construction and, on the other, a legal institution. The corollary of this theory is the doctrine of the State's self-obligation to the law. We then introduce Kelsen's perspective, which rejects the idea that the State is originally a social phenomenon and asserts that it is, in fact, synonymous with the legal order, thereby eliminating the question of the legal limits of the State. The final section is dedicated to Heller, who challenges the Kelsenian identification of the State with law, but proposes, unlike Jellinek, that the State is already normatively limited at its inception. Therefore, the focus of interest shifts to the question of the moral justification of the State. Finally, we summarize our discussion and offer some conclusions. Este artículo presenta una aproximación a la relación entre el Estado y el derecho a partir de un abordaje de la tradición alemana de la teoría del Estado, en particular de tres de sus exponentes más célebres: Georg Jellinek, Hans Kelsen y Hermann Heller. Nos concentramos en dos aspectos de esta relación: en los límites jurídicos del Estado y en su justificación moral, mediante una apelación a un concepto suprapositivo del derecho. La exposición se divide en tres partes, cada una dedicada a uno de estos teóricos.  En la primera, nos ocupamos de la teoría de las dos caras de la estatalidad de Jellinek, según la cual el Estado es, por un lado, una construcción social y, por el otro, una institución jurídica. El corolario de esta teoría es la doctrina de la autoobligación del Estado al derecho. Luego introducimos la perspectiva de Kelsen, que rechaza la idea de que el Estado es originariamente un fenómeno social y afirma que es, en realidad, un sinónimo del orden jurídico, de modo tal que elimina la pregunta por los límites jurídicos del Estado. El último apartado está dedicado a Heller, que impugna la identificación kelseniana entre Estado y derecho, pero plantea, a diferencia de Jellinek, que el Estado ya nace limitado normativamente. Por eso, desplaza el foco de interés a la pregunta por la justificación moral del Estado.
