VIII.4, que se refiere a la actuación delictual "iniuria" (con injuria), y no a la "iniuriam" (la injuria), en relación con los delitos de las Tablas VIII.2 y VIII.3, sobre la rotura de un miembro y la fractura de un hueso. La palabra "injuria", como sustantivo, no aparece en su texto, lo que sugiere que el delito de "injuria" no era conocido por la legislación decenviral, sino que su atribución como delito a la Tabla VIII.4 habría sido un fruto anacrónico de la interpretación posterior, una vez que ya se había creado el delito general de injuria. Pues bien, si asumimos que el texto genuino de la Tabla VIII.4 no utiliza “injuria” como sustantivo, sino como ablativo o adverbio ("con injuria", "injustamente"), enfrentamos la difícil tarea de explicar el sentido original de esta disposición arcaica. Asimismo, quiero insistir en la necesidad de integrar la información de Catón en Orígenes al análisis de las Tablas VIII.2, VIII.3 y VIII.4. Catón describe cómo se aplicaba el talión (talio) en actuaciones delictuales "iniuria" (con injuria), la rotura de miembro y la fractura de hueso, lo que completa el panorama y permite una interpretación coherente de las tres disposiciones decenvirales, a pesar de que los datos sigan siendo fragmentarios. Abstract: I wish to revisit and insist once again on a matter I pointed out some time ago: the function, context, and scope of the Table (tab.) VIII.4, which refers to an act made "iniuria" (with injury, unjustly), and not to an "iniuriam" (the delict of injury), and that it is related to the offenses contained within Tables VIII.2 and VIII.3, concerning the breaking of a limb and the fracturing of a bone. The word "injuria", as a noun, does not appear in the text, which suggests that the offense of "injuria" was not yet known on the age of the Decemviral legislation, and its attribution as an offense in Table VIII.4 would therefore be an anachronistic result of later interpretation. If we assume that the genuine form of the text in Table VIII.4 does not use "injuria" as a noun, but rather as an ablative or adverb ("with injury," "unjustly"), we face up the hard task of explaining its original meaning. Furthermore, I wish to emphasize the necessity to integrate the information given by Cato’s Origins book into the analysis of the Tables VIII.2, VIII.3, and VIII.4.
