Existen opiniones encontradas entre los especialistas y estudiosos del Derecho Romano en cuanto a si este pueblo prodigioso pudo llegar a distinguir jurídicamente entre delito consumado y el instituto de la tentativa. Por nuestra parte, entendemos que, si no se puede hablar de un Derecho Penal Romano autónomo, mucho menos podemos referirnos a una teoría de la tentativa de delitos, lo que no quiere decir que los romanos no hayan podido llegar a diferenciar ciertas características propias de este instituto a partir de la noción de protección de la norma. Algo bastante parecido al germen de la noción de “bien jurídico protegido”.   ABSTRACT: The main objective of this paper is to address the problem of attempted crimes in Roman Criminal Law in the Justinian period. There are conflicting opinions among specialists and scientists of Roman Law as to whether this prodigious people was able to legally distinguish betweenthe consummated crime and the institute of criminal attempt. We hold that, if it is not possible to speak of an autonomous Roman Criminal Law, much less can we talk about an attempted crime theory, which does not mean that the Romans could not differentiate certain characteristics of this institute from the scope of protection of criminal law. It would be something quite similar to the germ of the notion of “legal protected good”.
