This logic involves a strong and unique idea of the events that replaces the many possible hypothesis of what happened. The evidence is used only to prove the preconceived idea. The system declares that the judicial procedure is the only way of seeking the truth based on evidence predetermined by law. It also claims that the legality of its actions is controlled by judges, even though the reality proves that the investigation is done by the police, using a series of violent practices. La violencia institucional es estructurante de las prácticas policiales desplegadas en la investigación judicial de los delitos, y debe ser analizada como una pieza clave para comprender las lógicas locales de la prueba judicial y la investigación de la verdad penal. En estas lógicas, la verdad sustituye a las hipótesis posibles, y todas las pruebas se orientan a demostrar lo que se cree ya sabido. Así, la investigación judicial de los delitos, que se define a sí misma como una búsqueda de la verdad organizada a partir de una serie de pruebas previstas por las normas y se dice controlada en su legalidad por los funcionarios judiciales, en los hechos es ejecutada por las policías a través de una cantidad de prácticas violentas que se hallan altamente naturalizadas y rutinizadas.
