Sumario:In the framework of higher education and especially in the teaching of law, the error of those who study has frequently been looked at from a punitive perspective, associated with the punishment they deserve, giving rise to a teacher reaction that generates scenarios of violence and discrimination. The article begins by exploring the notion of evaluation, as a strategy related to the purposes of teaching and then, its relationship with error, valuing it as raw material of the didactic process in the construction of a classroom feedback dialogue. From a rights perspective, we seek to deepen the recognition of the right to error that students have in higher education classrooms, which, far from holding punitively responsible those who make mistakes from the logic of punishment, seeks at enshrine a series of challenges and obligations in the teaching strategy on the part of those of us in charge of the classrooms
