The purpose is to analyze self-defense in the light of a case in which a woman victim of gender violence invokes such cause of justification. The invisibilization of women in the understanding of this issue will be evidenced, perpetrating a structurally unequal position between men and women in relation to criminal legislation, and the persistence of gender discrimination in current case-law decisions. Likewise, some Penal Code reform projects will be analyzed which expressly introduce among the causes of justification those cases in which the defense of a battered woman does not temporarily coincide with a physical aggression, but, regardless of this issue, the existence of gender-based violence cannot be ruled out Fil: Martínez, Agustina Lara. Buenos Aires, Argentina Argentina Martínez, Agustina Lara 2021 Este trabajo obtuvo el tercer puesto en la Convocatoria de la Revista Lecciones y Ensayos y del Programa de Género y Derecho para el Dossier "Violencias y/o discriminación de géneros y/u orientación sexual". -- El siguiente ensayo tiene como punto axial el estudio del instituto de la legítima defensa, en particular su carácter de actualidad en contextos generalizados de violencia por motivos de género en el ámbito intrafamiliar, tomando en consideración diversas propuestas legislativas de reforma del artículo 34, inciso 6º, del Código Penal, y una perspectiva acorde al corpus iuris de derechos humanos y sensible al género. Tendrá el propósito de analizar la legítima defensa a la luz de un caso en el cual una mujer víctima de violencia de género invoca dicha causa de justificación. Se evidenciará la invisibilización de las mujeres en el entendimiento de esta cuestión, perpetrando una posición estructuralmente desigual entre varones y mujeres en relación con la legislación penal, y la persistencia de la discriminación de género en la jurisprudencia actual.
