| Sumario: | Throughout this article, the main issues that encompass the parental responsibility of women with intellectual or psychosocial disabilities in our country are addressed, ramely, the regulatory framework that protects them and the judicial processes they usually go through (restriction of capacity and/or deprivation of parental responsibility). It also takes into account the System for the Comprehensive Protection of the Rights of Children and Adolescents, which highlights the rights and measures designed to prevent, respect, and guarantee the treatment that children and adolescents should have as subjects of law in these processes. The article also aims to reveal to what extent the Argentine State complies with the right of both mother and child to live with a family. The path chosen is through six sentences that systematically address the motherhood of these women. Each case is unique and unrepeatable, but from them we delineate some standards that should be applied in this matter, which are not entirely clear today |
