| Sumario: | The abusive filing of lawsuits to intimidate or punish public participation limits the free flow of information on matters of public interest and generates a chilling effect at the individual and collective level. While important normative advances have been made in the European Union and the Council of Europe, Latin American countries do not yet have legal tools to deal with this type of demands. In light of this, the article conceptualizes the phenomenon of SLAPP suits according to the American Convention on Human Rights and the duty of states to adopt domestic legal measures to guarantee freedom of expression. In line with European and local experiences, it concludes that this duty implies the adoption of legislative reforms that allow judges to dismiss SLAPP suits in early stages of the process and to mitigate their economic impact. |
