While important normative advances have been made in the European Union and the Council of Europe, Latin American countries do not yet have legal tools to deal with this type of demands. In light of this, the article conceptualizes the phenomenon of SLAPP suits according to the American Convention on Human Rights and the duty of states to adopt domestic legal measures to guarantee freedom of expression. In line with European and local experiences, it concludes that this duty implies the adoption of legislative reforms that allow judges to dismiss SLAPP suits in early stages of the process and to mitigate their economic impact. Mientras que han surgido importantes avances normativos en el ámbito de la Unión Europea y del Consejo de Europa, los países latinoamericanos aún no cuentan con herramientas legales destinadas a enfrentar este tipo de demandas. Frente a ello, el presente artículo conceptualiza el fenómeno de las demandas SLAPP a la luz de la Convención Americana sobre Derechos Humanos y del deber de los Estados de adoptar medidas de derecho interno para garantizar la libertad de expresión.
