Aparece así la tensión entre el postulado de la gobernanza de las migraciones en contraposición al abordaje de la migración como un derecho humano. En este sentido, las respuestas a la trata no siempre se han basado en los principios de los derechos humanos, sino que se ha distorsionado la naturaleza del problema al darle prioridad a otras preocupaciones como la prevención del delito y el control de las migraciones, por encima de los derechos de las víctimas. Esta situación ha puesto el foco, fundamentalmente durante la pandemia de Covid-19, sobre el rol de las políticas migratorias y los enfoques a partir de los cuales los Estados abordan estas problemáticas.
