Luego de una reseña del caso, se lo estudia en el contexto de la jurisprudencia anterior del tribunal relativa al uso de símbolos religiosos en el empleo privado y se observan continuidades y rupturas respecto de los estándares allí fijados. Finalmente, se elabora una crítica al concepto de neutralidad con el que este tribunal europeo ha analizado estos casos, a partir de la distinción entre "neutralidad formal" y "neutralidad sustantiva". El trabajo demuestra que una prohibición general de llevar símbolos religiosos en el empleo no es una política verdaderamente neutral, ya que coloca en una situación de desventaja a grupos religiosos minoritarios que reconocen una obligación de llevar consigo ciertos objetos o de vestir ciertas prendas.
