El primer enfoque sostiene que las instituciones deben efectuar el mismo tipo de razonamiento para garantizar la justificación de sus decisiones sobre derechos. Ese razonamiento se basa en el principio de proporcionalidad. El segundo enfoque sostiene que las instituciones deben especializarse en diferentes tipos de razonamiento. Así cada una de ellas realiza un aporte particular a la protección de los derechos.
