Sumario:This work arises from the proliferation of different journalistic approaches on events that are subject to criminal investigations with diverse perspectives. The current high social demand for information, the ramification of one journalistic sector (criminal investigation news) and the reticence from the Justice to take over their role of communicator of their decisions to society have generated parallel processes that can not only affect the parties involved and the rights that protect them, but also it can increase the crisis of legitimation of the administration of justice. Therefore, I intent to analyse the parallel processes problematic "or media trials" in juxtaposition with the criminal procedure and in relation to the method of construction of the truth. To this effect, I will start by analysing the relation between the administration of justice and mass media, to attempt to conceptualise parallel processes, the different forms of approaching facts (construction of truth) between the aforementioned and the legal process, and specify the correlation of said processes with the system of right that we call "due process". Finally, I will present the two approaches that have been used in this problematic in an international level and the defects or deficiencies of both of them, to conclude by outlining what I believe could constitute a possible solution
