The current high social demand for information, the ramification of one journalistic sector (criminal investigation news) and the reticence from the Justice to take over their role of communicator of their decisions to society have generated parallel processes that can not only affect the parties involved and the rights that protect them, but also it can increase the crisis of legitimation of the administration of justice. Therefore, I intent to analyse the parallel processes problematic "or media trials" in juxtaposition with the criminal procedure and in relation to the method of construction of the truth. To this effect, I will start by analysing the relation between the administration of justice and mass media, to attempt to conceptualise parallel processes, the different forms of approaching facts (construction of truth) between the aforementioned and the legal process, and specify the correlation of said processes with the system of right that we call "due process". Finally, I will present the two approaches that have been used in this problematic in an international level and the defects or deficiencies of both of them, to conclude by outlining what I believe could constitute a possible solution Fil: Chiaradia, Juan Manuel. Buenos Aires, Argentina Argentina Chiaradia, Juan Manuel 2023 El presente trabajo surge a partir la proliferación de distintos tipos de abordajes periodísticos sobre hechos que son objeto de investigaciones penales con diversas miradas. La gran demanda social de información actual, la ramificación de un sector periodístico específico (la noticia judicial) y la reticencia de la administración de justicia de asumir un rol de comunicador de sus decisiones a la sociedad condujeron a la generación de procesos paralelos que no solo pueden afectar a las partes involucradas y las garantías que las resguardan, sino también profundizar la crisis de legitimación de la administración de justicia. Así, pretendo analizar la problemática de los procesos paralelos "o juicios mediáticos" en contraposición con el proceso penal y con relación al modo de construcción de la verdad. Para ello, comenzaré analizando la relación entre la administración de justicia y los medios de comunicación, para intentar conceptualizar los procesos paralelos, las diversas formas de aproximarse a los hechos (construcción de la verdad) entre aquellos y el proceso penal y puntualizar la vinculación de esos procesos con el sistema de garantías que llamamos "debido proceso".
