This essay analyzes the distinctive traits of the object and method of the legal discipline, from different legal-philosophical perspectives, in order to test whether it is a science, at least from the traditional epistemology standards (problem introduced in section I). Therefore, in the first place, the theoretical premises are established in relation to the requirements that any discipline must meet to produce "scientific knowledge" (section II). Then, the different philosophy of law schools' thesis are examined regarding what is the object of "law"/"jurisprudence" and whether they present epistemological objections, with special emphasis on the relationship between law and language in current regulatory systems (section III). Our next step is the study of the evolution of the legal interpretation theory -as the main method of this discipline, approached both by the theory of law and by the philosophy of law -, pointing out the different extra-normative factors that are used in judge's work (section IV). In the same way, I present which is the mission of the jurist, according to prominent doctrine, insofar as he seeks to establish himself as a "legal scientist" (section V). Once the inescapable link between law and morality as legal operator's tools has been affirmed, I set my metaethical premises and I investigate how these different knowledges are related in postmodern law (section VI). Finally, I conclude that law is not a science but a true power technique, with the consequent ethical, political and ideological responsibilities that this generates in the legal operator (section VII). |

Buenos Aires, Argentina Mojico, Facundo Esteban Jurisdiccion internacional Mojico, Facundo Esteban 2022 Este ensayo analiza las peculiaridades del objeto y método de la disciplina jurídica, desde distintas perspectivas iusfilosóficas, a fin de poner a prueba si se trata de una ciencia, al menos a partir de los cánones de la epistemología tradicional, problema introducido en el apartado I. Para ello, en primer lugar, se sientan las premisas teóricas con relación a las características que debe una reunir cualquier disciplina para producir "conocimiento científico"(apartado II). Luego, se examinan las tesis de las distintas escuelas iusfilosóficas (entre otras, positivismo, iusnaturalismo, realismo jurídico, trialismo) respecto a cuál es el objeto del "derecho" y se analiza si les caben objeciones epistemológicas, haciendo especial énfasis en la relación entre derecho y lenguaje en los sistemas normativos actuales (apartado III). El siguiente paso es el estudio de la evolución de la teoría de la interpretación jurídica - como método principal de esta disciplina, abordado tanto por la teoría del derecho como por la filosofía del derecho -, apuntándose los distintos factores extranormativos que se ponen en juego en la labor del juez, tanto en la subsunción como en la ponderación (apartado IV). En la misma línea, expongo cuál es la misión del jurista, de acuerdo a destacada doctrina, en tanto pretenda erigirse en "científico del derecho" (apartado V). Una vez afirmado el ineludible vínculo entre el derecho y la moral como herramientas del operador jurídico, siento mis puntos de partida metaéticos e indago cómo juegan estos saberes en el derecho posmoderno (apartado VI).
