Sumario:Abstract: The article explores two current interpretative tendencies that seem to converge in the judicial practice of our country in the enforcement of the law (the interpretivism and the formalism) and which main characteristic derives from the fact that both seem to represent distorted versions of the two major occidental judicial models (the common law and the continental law) and, as such, both tendencies seem to conspire against the possibility to develop a consistent judicial practice.
