This disparity is one of the many generated by financial capitalism that the pandemic has placed in the center of the discussion. In this context, disproportionate corporate power through monopoly of patents turns out to be the arbitrator between life and death. Up until now States have failed to achieve a multilateral and cooperative effort to secure universal access to vaccines. This paper puts forward the States' duty to take a different path and make vaccination accessible. This international duty emerges from precise legal obligations from the right to life, the right to health and the right to enjoy the benefits of scientific progress as well as the social function of private property. The must ensure international cooperation, in the context of this unprecedented global health emergency. But, also, it is the only rational attitude that is expected from the international community to face in an effective way a global pandemic that does not admit being controlled only in one State or a few States.

Algunos pocos países, los de mayor poder económico y tecnológico, han adquirido vacunas en exceso, otros las han podido comprar a cuentagotas y aún otros no disponen de vacunas. Esta asimetría es hoy una de las tantas del capitalismo financiero que la pandemia ha puesto en el centro de la escena. El dominio corporativo desproporcionado a través del monopolio de las patentes se erige en definitiva en árbitro de la vida y la muerte. Los Estados han fallado hasta el momento en llevar adelante un esfuerzo mancomunado, cooperativo y multilateral para lograr el acceso universal, equitativo y no discriminatorio a la vacunación de la población mundial. En este contexto, el trabajo plantea el deber de los Estados de desandar sus pasos y actuar de inmediato y deliberadamente en pos de tornar universalmente accesible las vacunas por el COVID-19. Este deber internacional surge de la combinación de las obligaciones precisas respecto de los derechos a la vida, a la salud y a gozar de los beneficios del progreso científico, de la función social de la propiedad privada y de realizar la cooperación internacional, todo ello en el marco de una emergencia sanitaria sin precedentes como la actual.
