Sumario:The Role of the Mother in the Action of Filiation. -- Abstract: This work analyzes the active and passive legitimacy of the mother in the damages? claim, based on the lack of voluntary parental recognition of the common child. The right affected by non-recognition is the right to identity of the child, who is solely entitled to claim non-patrimonial damages. The mother, as indirectly affected, may only seek property damage under the limitation imposed on her by Article 1741 of the Civil and Commercial Code of the Nation. At the same time, the delay in promoting the action of filiation on behalf of its minor child, will make her co-author of the damages suffered by the latter, since by the rule of the provisions of Articles 583 and 1710, inc. b) of the Civil and Commercial Code of the Nation, is obliged to cooperate with the determination of the paternity of his son and to take the reasonable and necessary measures toavoid the production or aggravation of the damage already caused. In an appropriate judgment, the child?s right to identity has priority over the mother?s right to privacy and therefore cannot serve as a justification for breaching the duty to promote the claim in due course Article 583 of the new Civil and Commercial Code is presented as a damage prevention tool which, in turn, promotes the protection of the family.
