The mother, as indirectly affected, may only seek property damage under the limitation imposed on her by Article 1741 of the Civil and Commercial Code of the Nation. At the same time, the delay in promoting the action of filiation on behalf of its minor child, will make her co-author of the damages suffered by the latter, since by the rule of the provisions of Articles 583 and 1710, inc. b) of the Civil and Commercial Code of the Nation, is obliged to cooperate with the determination of the paternity of his son and to take the reasonable and necessary measures toavoid the production or aggravation of the damage already caused. In an appropriate judgment, the child?s right to identity has priority over the mother?s right to privacy and therefore cannot serve as a justification for breaching the duty to promote the claim in due course Article 583 of the new Civil and Commercial Code is presented as a damage prevention tool which, in turn, promotes the protection of the family.

El derecho afectado por la falta de reconocimiento es el derecho a la identidad del hijo, quien resulta único legitimado para reclamar el resarcimiento del daño no patrimonial. La madre, en tanto damnificada indirecta, solo podrá reclamar el resarcimiento del daño patrimonial en virtud de la limitación que le impone el art. 1741 del Cód. Civ. Y Com. de la Nación. Paralelamente, la demora en promover la acción de reclamación de la filiación en representación de su hijo menor, la convertirá en coautora de los daños y perjuicios que experimente este último, ya que por imperio de lo dispuesto por los arts. 583 y 1710, inc. b) del Cód. Civ. y Com. de la Nación, se encuentra obligada a colaborar con la determinación de la paternidad de su hijo y adoptar las medidas razonables y necesarias para evitar la producción o agravamiento del daño ya causado. En un juicio de ponderación adecuado, el derecho a la intimidad de la madre se encuentra por debajo del derecho a la identidad del hijo y, por lo tanto, no puede servir de justificación para incumplir el deber de promover la acción de reclamación en debido tiempo.
