This article explores the Registration Air Law and its guiding principles from the common law perspective. This is due to the fact that this law inspires the Convention on International Interests in Mobile Equipment and the Aircraft Protocol, signed in Cape Town in 2001. We will then focus on the analysis of the aforementioned International Instrument, from its origins and its legal basis until the analysis thereof. We also study the generations of different interests, with a particular focus on the third generation of interests with its own characteristics, which have been imposed from the industry. To do this we will review how the guarantees arise from, the ways to obtain their protection, as well as the specific default remedies and the extinction of the interests. Thus, the legal science seeks to provide new tools to the financial market through a new registration paradigm. This legal system has an impact on industry by reducing the interest rate in order to obtain the availability of certain aircrafts and engines. We intend to systematize the study of the Convention and the legal relationships contemplated. In addition, we will analyze the implementation of the International Registry of Mobile Assets created by the Convention. Finally, we present some conclusions. |

Capaldo, coord. -- Resumen: El presente artículo explorará el derecho aeronáutico registral y sus principios rectores desde el prisma del derecho anglosajón. Ello, porque este derecho inspira el Convenio relativo a las Garantías Internacionales sobre Elementos de Equipo Móvil y su Protocolo Específico de los Elementos de Equipo Aeronáutico firmado en Ciudad del Cabo hacia el año 2001. Luego nos centraremos en el estudio del citado instrumento internacional, desde sus orígenes y su fundamentación hasta llegar al análisis del mismo. Analizaremos las diferentes generaciones de garantías centrándonos en las garantías de tercera generación, con sus características propias, que han sido impuestas desde la industria. Para ello veremos la creación de las garantías, su protección, los mecanismos ante el incumplimiento y la extinción de las mismas. Así, las ciencias jurídicas procuran dar nuevas herramientas al mercado financiero a través de un nuevo paradigma registral. Dicho orden jurídico impacta en la industria reduciendo la tasa de interés para obtener la disponibilidad de ciertas aeronaves y motores. Procuraremos sistematizar el estudio del Convenio y las relaciones jurídicas que contempla. También analizaremos la instrumentación del Registro Internacional de Equipos Móviles Aeronáuticos creado por el Tratado.
