| Sumario: | In this article we will address the link between the human right to water and protection regime given by international law TBI investments. There are discussions on the hierarchical value of human rights; the dispute over the allocation of economic resources; the fragmentary feature of international law that allows situations like development rights at different speeds between the protection regime of private investment and protection of human rights; and finally, how it is that BITs operate as systemic constraint so that they can be tested new forms of management of potable water and sanitation, in order to recover the situation in which private management transnational has left behind the period known as "privatization" of public services. We have taken the ICSID Case "Suez v. Argentina" as an example for the analysis from legal hermeneutics. |
