In this article we will address the link between the human right to water and protection regime given by international law TBI investments. There are discussions on the hierarchical value of human rights; the dispute over the allocation of economic resources; the fragmentary feature of international law that allows situations like development rights at different speeds between the protection regime of private investment and protection of human rights; and finally, how it is that BITs operate as systemic constraint so that they can be tested new forms of management of potable water and sanitation, in order to recover the situation in which private management transnational has left behind the period known as "privatization" of public services. Existen discusiones sobre el valor jerárquico de los derechos humanos; la disputa por la asignación de recursos económicos; la característica fragmentaria del derecho internacional que permite situaciones como la de un desarrollo de derechos a distintas velocidades entre el régimen de protección de inversiones privadas y el de protección de los derechos humanos; y, por último, cómo es que los TBI operan como condicionante sistémico para que puedan ensayarse nuevas formas de gestión de los servicios de agua potable y saneamiento, de modo de recuperar la situación en que la gestión privada transnacional la ha dejado tras el período conocido como de "privatización" de los servicios públicos. Hemos tomado el caso CIADI "Suez v.
