Economic and patrimonial violence against women and their children is an issue that research is making visible, both at the international and national levels. This is true, in particular since the end of 1990s and beginning of 2000s. I argue that this type of gender-based violence constitutes an attack to women´s freedom, since economic and patrimonial gender violence hinders women´s economic autonomy, which is fundamental for them to carry out their lives in a fulfilling way and free from violence. In this essay, I presentthe state-of-the-art by reviewing international and national studies, and I analyse the emerging Argentinian case-law on this matter in light of international human rights standards and National Act 26.485 on comprehensive protection to prevent, sanction and eradicate violence against women where they develop their inter-personal relations. From the specific literature and case-lawit stems that economic-patrimonial gender-based violence is used by male aggressors (former partners) to continue exerting control and power over women after their relationships have concluded. Furthermore, this type of violence is exercised through fraudulent manoeuvres and the manipulation of legal evidence and judicial proceedings, usually involving third parties in conducts that damage the aggressors' former female partners and their children. This exploration points out that to achieve an effective halt to economic-patrimonial gender-based violence, the Courts have to conduct the proceedings in a creative and committed way, employing all the legal tools provided by the national, local and international legal framework. |

Gómez. -- Resumen: La violencia de género económico-patrimonial contra la mujer y sus hij s es un tema que, tanto a nivel internacional como nacional está adquiriendo visibilización a través de investigaciones especialmente desde fines de la década de los años 1990 y comienzos de los años 2000. Argumento que este tipo de violencia de género constituye un ataque a la libertad de las mujeres, ya que violenta su autonomía económica, la cual es fundamental para permitirle vivir una vida plena y sin violencia. En este trabajo presento el estado de arte compuesto de estudios internacionales y nacionales, y analizo la incipiente jurisprudencia argentina dictada en la materia en el contexto de los estándares jurídicos internacionales de derechos humanos y de la ley 26.485 de Protección Integral para Prevenir, Sancionar y Erradicar la Violencia contra las Mujeres en los Ámbitos donde Desarrollan sus Relaciones Interpersonales. De la literatura y de la jurisprudencia específica se observa que la violencia de género económico-patrimonial es instrumentada por los agresores (ex parejas) de las mujeres para continuar con su control y dominio sobre la mujer una vez finalizada la relación, y que se expresa en maniobras fraudulentas, manipulaciones de las pruebas y de los procesos judiciales, y suele involucrar a terceras personas que participan de estas conductas en perjuicio de las exparejas mujeres, y de las/os hijas/os del agresor.
