Although it seems like a contradiction to inquire about the possibility of finding judicial justification for a person that decides to "lynch" another one who has allegedly committed a crime, it is true that the public debate aroused by this attacks urges us to address this matter. It's imperative to act with more social responsibility that the one already displayed, noticing the danger of these acts for the society as a whole. In any case, we should urge the State to accomplish its responsibility to guarantee public safety to the citizenship as stressed by the Constitution Fil: Basterra, Marcela I. Buenos Aires, Argentina Argentina Basterra, Marcela I. 2014 Los hechos ocurridos en nuestro país denominados popularmente "linchamientos", destacan el inmenso valor que en cualquier sociedad adquiere el Estado constitucional de derecho. El fenómeno de la inseguridad, la percepción ciudadana del fracaso del Estado como garante de la seguridad, ha crecido en forma exponencial durante la última década. Si bien parece un contrasentido indagar acerca de la posibilidad de encontrar algún justificativo jurídico, para una persona que decide "linchar" a otra que supuestamente cometió un delito; lo cierto es que el debate público que han generado estos episodios, nos invita a abordar este interrogante. Resulta imperioso actuar con mayor responsabilidad social que la exhibida, advirtiendo la peligrosidad que tienen estos actos, para la sociedad en su conjunto.
