Once established the link between retributivism and punishment of the authors of crimes against humanity, I will sustain that retributivism should be defended for all crimes, arguing that this is the only way to preserve equality among victims. Mar del Plata, Argentina Fernández Fiks, Tomás 2017 En el presente trabajo sostendré que las decisiones de tribunales penales tanto internacionales como locales que han condenado a los autores de graves violaciones a los derechos humanos, desde Núremberg hasta el presente, encuentran su mejor justificación en una teoría del castigo retribucionista. Para establecer ello, tengo en cuenta: i) el lenguaje de dichas decisiones; ii) la inadecuación de otras teorías justificatorias del castigo; iii) el valor justificatorio de nuestras intuiciones morales en cuanto a que castigar a los responsables de estos crímenes es hacer lo correcto.
