Sumario:"Based on international law, legal opinions and doctrinal debates, the new National Criminal Procedure Code reflects a paradigm shift. As a consequence of the acknowledgement of the victim's broad rights and faculties, it incorporates the notion of autonomous complainant and the institution of action transformation. This essay analyses the path that leads to the annexation of those legislative innovations, departing from the devolution of the conflict which had been expropriated from the victims, their autonomy and the introduction of a ruled prosecutorial discretion principle. In addition, two inconveniences which are entailed to the procedure of action transformation will be analized: the tension existing between the victims "interests and the accused's rights and the double accusation that arises when a state prosecutor conducts the process."
