In order to do so, and convinced that dogmatic answers like "the criminal law guarantees must be respected because they are on the Constitution and in International Human Rights Treaties" are not solid enough, I will start by showing ethical and historic factors that advise that is better to respect them, to later focus on which I consider that is the main reason: we must respect them in order to avoid some consequences that may be harmful to the rule of law. La Plata, Argentina Larsen, Pablo 2015 Este artículo pretende realizar algunos aportes al debate de la aparente contraposición existente entre la eficiencia en la persecución del delito, por un lado, y el respeto de las garantías penales, por el otro. Convencido de que respuestas dogmáticas tales como "las garantías deben ser respetadas porque así lo establecen la CN y los Instrumentos Internacionales de Protección de Derechos Humanos" no son suficientes, comenzaré analizando factores éticos e históricos que aconsejan respetarlas, para concluir en que la razón fundamental reside en que las mismas pretenden evitar determinadas consecuencias que, de acontecer, serían nefastas para la vigencia del Estado de derecho.
