| Sumario: | At the date hereof, Argentina has not regulated what is legislatively-called\n"class actions". Therefore in the place we will take a brief historical overview of the different jurisprudential creations by our High Court throughout times that were later turned into laws by the legislative branch or by the constituent member. We will analyze what was the reason for doing that. Then, we will invite the reader to wonder why these bodies\nshould heed the Supreme Court: we will rehearse our response to that question.\nThirdly, since the enactment of "Halabi" court ruling - which contains\nthe "class actions" - and with the omission of the legislative branch to incorporate it to the positive law - possible case of unconstitutionality by\nomission -, we will highlight this anomalous situation along with a brief conceptual and historical review of this procedural tool that so far, has not run with the same fate as the legal background that will be quoted. That is why we notice about the need for legislative hosting to consider the benefits that this would entail. Against this background of "judicial\nactivism" - case of "counter-majoritarian objection" - we propose a way for overcoming it |
