It is stated that the line of reasoning developed in that respect by Sancinetti implies considering the negative result as decisive, which appears to be in contradiction to the central idea of the author. El presente artículo se propone esbozar algunos considerandos objetando esta postura, para así efectuar algunas observaciones sobre el principio de imputación concebido por Marcelo Sancinetti para resolver estos supuestos, denominado ?principio de subrogación?. Se pone de manifiesto que la argumentación elaborada en este sentido por Sancinetti importa reconocer al disvalor de resultado como determinante, lo que se manifiesta como contrario al pensamiento medular del propio doctrinario.
