During both moments, differentiated ways to accessing justice were implemented for different categories of peoples or social groups. Our goal is to analyze the arguments employed and the interests at stake when defending a differentiated access to justice; the conditions in which indigenous courts were created; and the recognition of autochthonous normative systems by the Spanish crown and the national states. We will develop this reflection, which entwines historical and anthropological approaches, along with historiographical considerations regarding the way in which the concept of legal pluralism has developed, in the last decades, as an analytical category to investigate Latin American normative systems in diverse moments of its history, and how alternative proposals have emerged.

El trabajo compara fundamentos teóricos, características y beneficiarios de sistemas de justicia desarrollados en América Latina en dos momentos históricos: la época colonial y el período de reformas constitucionales de los años 1990, cuando se implementaron vías diferenciadas de acceso a la justicia para categorías distintas de personas. Se analizan los argumentos esgrimidos y los intereses en juego en la defensa de un modelo diferenciado de acceso a la justicia; las condiciones en las que se crearon tribunales gestionados por pueblos indígenas; y el reconocimiento de los sistemas normativos autóctonos por la Corona española y los Estados nacionales. Esta reflexión, que entrelaza el acercamiento histórico y antropológico, va de la mano de aquella que atañe a la forma en que el concepto de pluralismo legal se ha erigido como categoría para investigar los sistemas normativos de América Latina en diversos momentos de su historia, así como a las alternativas surgidas desde entonces. O objetivo do presente trabalho é comparar os fundamentos teóricos, as características e os beneficiários dos sistemas de justiça que se desenvolveram na América Latina em dois momentos históricos, a saber: no período  colonial e no período decorrente das reformas constitucionais de 1990s, quando foram implementadas vias diferenciadas de acesso à justiça para distintas categorias de pessoas. Propõe-se analisar os argumentos apresentados e os interesses em jogo na defesa de um modelo diferenciado de acesso à justiça, as condições em que foram criados os tribunais administrados pelos povos indígenas e o reconhecimento dos sistemas normativos autóctones pela Coroa espanhola e pelos Estados nacionais.
