One of the most praised elements in the recent legislative changes related to children and their rights is the so called “un-judicialization” of social care. It has been argued that, this transformation resulted in a reduction in the arbitrariness to which children and families from popular strata were subjected in courts. In this paper, I hope to suspend this assumption in order to move forward in the reflections on its implications in the everyday dimension of the state practices designed to "restore rights". To do this, I inquire here from an ethnographic perspective, in the actions of state agents from a Servicio Local de Protección de Derechos de Niños in a township from the Buenos Aires conurbation in contexts signed by social inequality. Particularly those deployed to deal with problematic situations of children marked by adult practices, usually interpreted as criminal activities - such as child abuse or sexual abuse-. |

Uno de los elementos más ponderados de las recientes transformaciones legislativas referidas a la infancia y sus derechos, ha sido la “desjudicialización” de las intervenciones de origen “asistencial”. Se ha argumentado que dicha transformación supuso una merma en la arbitrariedad a la que estaban sometidos los niños y familias de sectores populares en los ámbitos tribunalicios. En el presente trabajo, se busca suspender tal asunción para avanzar en las reflexiones sobre sus implicancias en la dimensión cotidiana de las prácticas estatales destinadas a “restituir derechos”. Para ello indago aquí, desde una perspectiva etnográfica, en las actuaciones desplegadas por agentes de un Servicio Local de Protección de Derechos de Niños en un municipio del conurbano bonaerense en contextos marcados por la desigualdad social. En particular aquellas desplegadas frente a situaciones problemáticas de niños que se encuentran atravesadas por prácticas adultas, habitualmente interpretadas como delictuosas -por ejemplo maltrato infantil o abuso sexual-. Um dos elementos mais celebrados das recentes mudanças legislativas relacionadas com as crianças e seus direitos tem sido a “des- judicialização”das intervenções de origem asistencial. Tem sido argumentado que essa mudança gerou um declínio na arbitrariedade a que as crianças e as famílias de setores populares foram submetidas no campo judicial. Neste artigo, buscamos suspender este pressuposto para promover reflexões sobre as suas implicações na dimensão cotidiana das práticas estatais destinadas a "restaurar direitos". Para fazer isso, analiso aqui a partir de uma perspectiva etnográfica, as ações realizadas por agentes de um Servicio Local de Protección de Derechos de Niños em um município de Buenos Aires, em contextos marcados pela desigualdade social.
