This process coincided with the implementation of similar policies in other Latin American countries. Because of this expropriation, collective property was dismantled, a major part of the lands was auctioned, and private and individual ownership was imposed on community members. In this article, we argue that the land rights of “comuneros” were redefined because of the implementation of that law, but also by the agency of the community members, who monitored, negotiated and confronted different positions during the process. We study a key moment in the process of defining land rights: the formation and revision of censuses of the communities. This process was very controversial because it attributed specific content to the category of “comunero” (i.e. defined which community members would be entitled to receive a portion of the divided lands and a percentage of the amount obtained by the auction of the rest).

This process was very controversial because it attributed specific content to the category of “comunero” (i.e. defined which community members would be entitled to receive a portion of the divided lands and a percentage of the amount obtained by the auction of the rest).  Entre las décadas de 1880 y 1890 se llevó a cabo la expropiación y división de las tierras de las “comunidades indígenas” de Córdoba, ordenada por una ley provincial de 1881, coincidiendo con una coyuntura de políticas similares aplicadas en distintos países de Latinoamérica. Con la expropiación se desarticuló la propiedad colectiva de esas tierras, una parte importante de las mismas fue rematada y se impuso la propiedad privada e individual a los miembros de las comunidades. En este artículo sostenemos que los derechos de tierras de los comuneros se redefinieron como resultado de la aplicación de esa ley, pero también por la agencia de los propios miembros de las comunidades que vigilaron, negociaron y confrontaron distintas posturas en el curso del proceso. Estudiamos un momento clave en ese proceso de definición de derechos de tierras: la formación y revisión de los padrones de las comunidades que fueron muy controvertidas porque dieron un contenido concreto a la categoría “comunero”, es decir, definieron quiénes eran los miembros de la comunidad que quedarían con derecho a recibir una parte de las tierras divididas y un porcentaje del monto obtenido por el remate de las restantes.  Pendant les années 1880-1890 et à partir d’une loi provinciale de 1881 s’exécuta à Córdoba l’expropriation et la division des terres appartenant aux communautés indigènes. Fait qui coïncide avec un processus de politiques similaires qui ont été menées à l’époque dans différents pays d’Amérique Latine. Cette expropriation provoquant la désarticulation de la propriété collective des terres, une partie significative des terres furent vendues, imposa aux membres de la communauté la propriété privée et individuelle. Nous soutenons dans cet article que les droits des terres de “comuneros” (membres de la communauté) ont été redéfinis non seulement en application de cette loi, mais aussi pour l’agence des membres des communautés qui ont eux-mêmes surveillé, négocié et confronté des différentes positions tout au long du processus. Nous abordons un moment clé de ce processus de définition des droits de terres: constitution et révision de recensements des communautés.
