Even though the core of the quandary is in the XIX century and the earlier decades of the XX century, it was unavoidable to refer to the colonial period in search of certain answers, it was impossible as well to ignore the current recognition demands of the communal and rural movements. The core of this research will be the changes in the concept and rights to ownership, the governmental definition regarding them, and the effect in the process of confiscation to the land of the aboriginal people of the region. Propongo exponer algunos interrogantes y cuestiones en torno a los derechos de propiedad, reflexiones que fueron surgiendo a lo largo de una extensa investigación que aborda, en forma comparativa, las estructuras agrarias y las políticas estatales respecto a la propiedad territorial en las regiones de Puna, valles de altura y su borde pedemontano a ambos lados de la frontera argentino-boliviana. Si bien el núcleo de la problemática se sitúa, y mis preguntas partieron, del siglo XIX y primeras décadas del siglo XX, me resultó ineludible remitirme al período colonial en busca de respuestas; por otra parte se torna imposible desconocer la actualidad de los planteos reivindicatorios de la propiedad comunal y campesina. Abordaré como eje principal los cambios en el concepto y en los derechos de propiedad, las definiciones gubernamentales en torno a los mismos y su incidencia en el proceso de desamortización y ex vinculación de la tierra en los pueblos de indios de la región. L’article propose d’exposer quelques questions autour des droits de propriété, des réflexions qui sont apparues tout au long d’une recherche qui aborde, de façon comparative, les structures agraires et les politiques des gouvernements en ce qui concerne la propriété foncière dans les régions de puna, vallées d’altitude et de leur bordure de piémont des deux côtés de la frontière argentino-bolivienne. Bien que le noyau de la problématique et mes questions soient partis du XIXº siècle et des premières décennies du XXº, j’ai dû remonter à la période coloniale en cherchant des réponses; par ailleurs il était également impossible d’ignorer l’actualité des revendications de la propriété communale et paysanne.
