These elements include a series of instruments such as the Constitution of the Republic of Ecuador, the National Plan for Good Living, the United Nations, the Latin American Center for Development Administration, in order to seek the construction of an open, close, efficient and effective government. To carry out this task, a series of technological and human elements are required, which encourage or promote citizen participation through their direct and indirect mechanisms, especially with those that refer to access to public information that comes from the essence of electronic government. The implementation of electronic government is an ideal means to encourage citizen participation online, since it will allow a government, regardless of its level within the public administration, to promote specific policies and concrete mechanisms of electronic participation using ICTs in the information, consultation, decision, control and execution processes. El presente artículo analiza los elementos jurídicos del gobierno electrónico (e-gobierno) en Ecuador. Entre estos elementos se cuenta con una seria de instrumentos y apoyo de instituciones tales como, la Constitución de la República del Ecuador, el Plan Nacional del Buen Vivir, la Organización de Naciones Unidas, el Centro Latinoamericano de Administración para el Desarrollo. De esta manera, se busca la construcción de un gobierno abierto, cercano, eficiente y eficaz. Para la realización de esta tarea se requiere una serie de elementos tanto tecnológicos como humanos, que incentiven o promuevan la participación ciudadana mediante sus mecanismos directo e indirectos, especialmente con aquellos que hacen referencia al acceso a la información pública que viene en la esencia del gobierno electrónico. La implementación del gobierno electrónico es un medio idóneo para incentivar la participación ciudadana en línea, dado que va a permitir que un gobierno, independientemente de su nivel dentro de la administración pública, fomente políticas específicas y mecanismos concretos de participación electrónica utilizando las TICs en los procesos de información, consulta, decisión, control y ejecución.
