El derecho humano a la privacidad y el manejo de los datos personales transfronterizos, demanda la máxima protección frente al intercambio de información que se desarrolla entre los distintos países por diversos temas, como la salud, la política, el comercio y por el uso de las nuevas tecnologías, así como, la posible colisión con el derecho al acceso a la información. Analizar el tratamiento y normativa europea, así como, la recepción normativa mexicana como país latinoamericano de vanguardia y firmante del Convenio 108 de Estrasburgo es de la mayor importancia.
