Sumario:This document aims to analyze the legal implications of compliance or compliance programs in guaranteeing fundamental constitutional rights in Colombia. Initially analyzing general aspects and ideas that approximate the understanding of the Economic Constitution, freedom of business and the Social Rule of Law, followed by compliance programs in the strict sense and finally its relationship with fundamental rights within the framework of its warranty. The work concludes that the idea of ​​economic utility constitutes a foundation for the violation of fundamental rights, necessitating the inclusion of ethical and moral criteria on business behavior based on constitutional postulates.
